On August 20th, FERC extended two pandemic emergency-related waivers pursuant to section 206 of the Federal Power Act that were set to expire on September 1st. These waivers have been extended through January 29, 2021. This extension was made in an effort to provide continued safety and flexibility for the public and the companies FERC regulates.
The first waiver FERC extended concerned notarization and in-person meeting requirements in open access transmission tariffs. Notarization and other meeting mandates have been difficult to obtain or perform during the pandemic. This waiver was originally enacted on April 2nd of this year. The second waiver was extended by the FERC Office of the Secretary and was also in regards to regulations requiring that filings be notarized or supported by sworn declarations. The Secretary originally issued this waiver April 2nd, and it was previously extended on May 8th.
